Using our services

Terms & Conditions

These terms apply when a business asks Draco Business Solutions Ltd to provide business energy consultancy, comparison or related support.

1. About Draco

Draco Business Solutions Ltd (“Draco”, “we”, “us” or “our”) is a company registered in England and Wales under company number 17088524. Our registered address is Unit 13, Freeland Park, Wareham Road, Lytchett Matravers, Poole, Dorset, BH16 6FA.

2. Our service

We help business customers review energy requirements, obtain and compare available supplier quotations, understand key contract terms, arrange selected contracts and manage related supplier or renewal enquiries. We act as an energy consultant and intermediary, not as an energy supplier.

The availability of suppliers, products and prices will vary. We do not claim to compare every supplier or every product in the market.

3. Your authority and instructions

You confirm that the person instructing us has authority to act for the business. You may be asked to sign a Letter of Authority allowing Draco and its service partners to obtain account and industry data, request quotations and communicate with suppliers on your behalf.

Unless expressly agreed in writing, a Letter of Authority does not itself authorise Draco to enter into an energy supply contract for you.

4. Information you provide

You are responsible for providing complete and accurate information, including meter details, consumption, contract dates, business status and site information. Quotations may change or be withdrawn if the information supplied is incomplete, inaccurate or no longer current.

5. Quotations and supplier contracts

A quotation is not guaranteed until it is accepted and confirmed in accordance with the relevant supplier's requirements. Prices and terms may be changed or withdrawn by a supplier before confirmation.

The energy supply contract is between you and the chosen supplier and is governed by that supplier's terms. You should review the contract summary, price, duration, payment terms and any termination provisions before agreeing.

6. Verbal and written agreement

Where permitted by the supplier and applicable law, a contract may be agreed verbally, electronically or in writing. If a material agreement is reached by telephone, Draco will provide or arrange an English confirmation of the key terms before proceeding or as part of the supplier's confirmation process.

7. Cost and commission

You do not pay Draco a separate consultancy fee. If you arrange a contract through us, Draco and/or our intermediary receive commission from the energy supplier. This commission may be included in the rates or commercial terms offered.

We will provide information about the nature of our remuneration and, where applicable, further commission disclosure on request or as required by law or industry rules.

8. No guarantee of savings

We aim to present suitable options clearly, but we do not guarantee that a particular contract will be the cheapest available, that savings will be achieved, or that future market prices will move in a particular direction. The final commercial decision remains yours.

9. Third parties

We may work with aggregators, data services, energy suppliers and other service partners to provide our service. We are not responsible for a supplier's performance, billing, systems, credit decision or failure to fulfil its own contract, although we may help you communicate with the supplier.

10. Communications and call recording

We may communicate by telephone, email, SMS, WhatsApp or WeChat. Material calls may be recorded where reasonably practicable for quality, training, compliance and dispute resolution. Important outcomes and formal contract records will be documented in English, including where explanations are provided in Cantonese or Mandarin.

11. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to that, Draco is not responsible for indirect or consequential loss, loss of profit, loss of business, or losses caused by inaccurate information supplied by you, supplier action, market movements or events outside our reasonable control. Any liability will be limited to the extent permitted by law and will reflect the services and circumstances giving rise to the claim.

12. Data protection

We handle personal information in accordance with applicable data protection law and our Privacy Policy.

13. Complaints

If you are dissatisfied with our service, please follow our Complaints Procedure. It explains how we investigate complaints and when an eligible customer may refer an unresolved dispute to the Energy Ombudsman.

14. Changes and severability

We may update these terms for future services. If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

15. Governing law

These terms and any non-contractual obligations arising from them are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to you.
